Please read these terms carefully before using ProviderPass.

These Terms of Use (“Terms”) govern your access to and use of the website at providerpass.au and your purchase of the NDIS Audit Pack (“Pack”) from Tether Technologies Pty Ltd (ABN 18 659 420 005), trading as ProviderPass (“we”, “us”, “our”).

By using the website or purchasing the Pack, you agree to these Terms. If you don't agree, please don't use the website or purchase the Pack.

ProviderPass is a trading name of Tether Technologies Pty Ltd.

2. The Pack — what you're buying

The NDIS Audit Pack is a digital product consisting of editable Microsoft Word and Excel templates aligned to the NDIS Practice Standards. It is intended for use by NDIS providers (or those preparing to register as NDIS providers) within their own organisation.

The Pack is delivered electronically by email after successful payment.

3. Pricing and payment

The Pack is sold for the price displayed on the providerpass.au/ndis-audit-pack page at the time of purchase. All prices are in Australian dollars and inclusive of GST.

Payment is processed by Stripe. We do not store or have access to your card details.

A tax invoice will be issued by Stripe at the time of purchase. If you require this invoice in your business name, enter your ABN at checkout.

4. Delivery

The Pack is delivered manually by email after we receive notification of successful payment. We aim to deliver within one business day. If you haven't received the Pack within two business days, email hello@providerpass.au and we'll resolve it promptly.

5. Refunds and your consumer rights

Digital product policy. Because the Pack is a digital product delivered electronically, we do not offer change-of-mind refunds once the Pack has been delivered. Please contact us before purchasing if you have questions about whether the Pack suits your needs.

Your rights under Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies your rights under the Australian Consumer Law. You are entitled to a refund or replacement if the Pack:

  • Has a major fault that makes it not fit for its purpose
  • Doesn't match the description on the website
  • Cannot be supplied as ordered

For minor faults (such as a corrupted file or a broken link), we will repair or replace the affected document at no cost. Email us at hello@providerpass.au to report any issue.

These rights are in addition to any other remedies available to you at law.

6. Licence — what you can and can't do with the Pack

When you purchase the Pack, we grant you a perpetual, non-exclusive, non-transferable licence to:

  • Use the Pack within your own NDIS provider organisation
  • Tailor and edit the documents to suit your operations
  • Provide the documents to your auditor and the NDIS Quality and Safeguards Commission as part of audit, registration, or ongoing compliance
  • Provide the documents to your own staff for internal use

You may not:

  • Resell, sublicense, redistribute, or share the Pack with any third party (other than as expressly permitted above)
  • Use the Pack on behalf of any other organisation as a paid consulting service
  • Publish, post online, or otherwise make the Pack publicly available
  • Remove or modify any copyright or attribution notices contained in the documents

The Pack is the intellectual property of Tether Technologies Pty Ltd.

7. No outcome guarantee

The Pack provides a documentation set aligned to the NDIS Practice Standards. We do not guarantee that purchasing or using the Pack will result in a successful NDIS audit, registration outcome, or any other specific outcome. Audit success depends on:

  • How you tailor each document to your specific business
  • Whether you operate in line with what's documented
  • Whether you maintain accurate evidence of your processes in operation
  • Factors outside the documentation, including auditor judgement

We are not a registered consulting firm and the Pack does not constitute legal, financial, or compliance advice. If you need professional advice on your specific circumstances, consult a qualified NDIS compliance consultant or solicitor.

8. Pack updates

When the NDIS Practice Standards are updated, we will use reasonable efforts to update the Pack and notify customers by email. Updates are provided at no additional cost where possible. We do not guarantee a specific update timeframe and we reserve the right to discontinue updates at any time, with reasonable notice.

9. Customer support

We provide reasonable email support to customers in relation to the Pack — for example, helping you understand what a document is for or how to tailor a section. We do not provide personalised compliance consulting, audit preparation services, or legal advice. If your question goes beyond the scope of the Pack itself, we may direct you to consult a qualified consultant.

10. Use of the website

You agree to use the providerpass.au website only for lawful purposes. You agree not to:

  • Use the website in any way that could disable, overburden, or impair it
  • Attempt to gain unauthorised access to the website, related systems, or other users' data
  • Use any automated means (bots, scrapers, crawlers) to access the website beyond what's permitted by our robots.txt
  • Reproduce or republish content from the website without our written permission

11. Intellectual property

All content on the website (including text, graphics, logos, images, and the Pack itself) is owned by Tether Technologies Pty Ltd or licensed to us, and is protected by Australian and international copyright laws. You may not reproduce, republish, or commercially exploit any of this content without our written permission.

The “ProviderPass” name and logo are trademarks of Tether Technologies Pty Ltd.

12. Limitation of liability

To the maximum extent permitted by law:

  • We provide the Pack and the website “as is” without warranties of any kind beyond those expressly stated in these Terms or required by law.
  • We are not liable for any indirect, consequential, incidental, or special loss or damage arising out of or in connection with your use of the Pack or the website, including loss of business, loss of revenue, loss of audit registration, loss of data, or loss of opportunity.
  • Where our liability cannot be excluded by law, our total liability to you in any matter is limited to either resupplying the Pack, or refunding the purchase price you paid for the Pack — at our option.

Nothing in this clause limits any rights you have under the Australian Consumer Law that cannot legally be excluded.

13. Privacy

We handle your personal information in line with our Privacy Policy, which forms part of these Terms.

14. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date will reflect any changes. The Terms in effect at the time of your purchase apply to that purchase. For significant changes affecting existing customers, we'll notify you by email.

Continuing to use the website after a change means you accept the updated Terms.

15. Termination

We may suspend or terminate your access to the website if you breach these Terms. If you breach the licence terms in clause 6 (e.g. by sharing or reselling the Pack), your licence to use the Pack ends immediately and we may take legal action to recover damages.

16. Governing law

These Terms are governed by the laws of Western Australia, Australia. Any dispute arising from these Terms or your use of the website or Pack is subject to the exclusive jurisdiction of the courts of Western Australia.
